How to fix wireless headset in xbox?

Question

I started having this problem a couple of weeks ago. My wireless headset seems to be connected as "controller/player1" and most of the time, i have to turn the headset off until i have loaded into the game. Otherwise, it won't let me do anything since it reads the headset as controller or player 1. Example. If I have the headset and controller on at the same time before loading into MW2 or NBA 2k, once the games loads I cannot do anything until the headset is turned off and the controller takes over as controller/player one. Any help?
