There is no problem in upgrading if you have a volume licence which is academic or non-profit.
Upgrade Windows Home to Windows Pro with a Volume License (nonprofit)
I work for a nonprofit. We have a volume license agreement with microsoft for Windows 10 Pro. We just purchased a laptop with Windows Home installed. I would like to use our volume license to upgrade. How do I do this? Thank you.
