Are images generated by Microsoft Designer available for commercial use?

This is a very confusing topic.

Are images generated by Microsoft Designer available for commercial use?

Section 1(b) states: "You agree that your use of Designer is for personal use only and not for

use in the course of trade or commerce."

While section 5 states: "Subject to your compliance with (i) this Agreement (and subject to the limitations in Paragraphs 1, 2, and 6) and (ii) the Microsoft Services Agreement, including the Code of Conduct, you may use Creations for any legal purpose."

Microsoft Designer uses DALLE-3 by openAi to generate images.

On openAi Website in regards to DALLE-3 it states: "Subject to the Content Policy and Terms, you own the images you create with DALL·E, including the right to reprint, sell, and merchandise – regardless of whether an image was generated through a free or paid credit."

So what is the verdict on this? This is entirely confusing.

    The Image Creator from Designer and the Designer for Web Image Generator are related but different programs.

    Image Creator from Designer: This is an advanced image generator powered by DALL-E and has no explicit restrictions on commercial use.

    Designer for Web Image Generator - This is intended for personal purposes. Provides templates and images web-friendly. This is not designed for commercial use.

    Since the images are for temporary flyers, they are not subject to the same restrictions as permanent logos for some services. If you have specific concerns regarding commercial use, I recommend seeking legal advice or clarifications directly from Microsoft.

    What is the difference between ‘Image Creator from Designer’ and ‘Designer for Web Image Generator’?

    My purpose behind using the image generator is to create designs to use on promotional flyers for local events. I am also adding my own personal text and dates to the designs and then selling the final product to the client.

    The images I am using are not going to be used for any permanent logo of any sort. They are used for temporary promotion of local events. The images I am using are also not going to be owned or attempted to be copyrighted by anyone. They are simply used for visual aid on temporary promotional flyers.
