Request for Clarification on Vietnam Tax Compliance and Foreign Contract Tax

We understand that Microsoft Regional Sales Pte Ltd has obtained a Vietnamese Tax Identification Number (TIN). In this regard, we would appreciate your clarification on the following questions: 

 

  1. Has Microsoft Regional Sales Pte Ltd registered to directly declare and pay all applicable taxes in Vietnam for the services provided to Vietnamese customers? 
  2. For payments made by our company to Microsoft Regional Sales Pte Ltd, are we still required to withhold and remit Vietnam Foreign Contractor Tax (FCT) on your behalf, or is Microsoft Regional Sales Pte Ltd solely responsible for filing and paying the relevant taxes directly to the Vietnamese tax authorities? 
  3. If we are still required under Vietnamese law to withhold and remit FCT on behalf of Microsoft Regional Sales Pte Ltd, would Microsoft Regional Sales Pte Ltd reimburse or credit us for tax withheld and paid to the Vietnamese tax authorities? If so, could you please explain the applicable process? 
  4. If available, could you also provide any official documentation or statement confirming Microsoft Regional Sales Pte Ltd’ s Vietnam tax registration and tax filing status that we may retain for our tax compliance records?
