Copying the profile picture to C:\Users<Yourname>\AppData\Roaming\Microsoft\Windows\AccountPictures
followed with a reboot fixed the issue. A simple fix for something that has been bugging me for months. Hope it helps someone else.

Maybe the image was simply reviewed and approved, with no connection to the copy and reboot operation.

you haven't said where it is being used that is reviewing it.
It may simply be the amount of skin colour, the bots used to find inappropriate pictures are improving but for some it is down to how much of the picture is skin.
Or it may have been reported by another member of the community, in this case, I can't see why anyone would.
Under review simply means it has been flagged for a person to look at, if it has been under review for some time, you might want to contact the Moderators to see if they can speed things up for you.
If it is here in Q&A, I may be able to escalate it for you.

Thanks for getting back to me. The profile picture is used on all of my Microsoft accounts. All but MSN accepts it.
All of the first level moderation on MSN is performed by bots and it is difficult to contact a person to sort anything.
If the notification gives any option to contact or appeal I would suggest you follow that.
The only other option is to use the feedback option in the bottom right of any MSN page.
I am sorry, but nobody in the Q&A community has any influence or control over the MSN community, or Moderator actions there.
All I can say is that, in my opinion, there is nothing wrong with the image and it would not be considered a problem here in Q&A, unfortunately I cannot help with the MSN Community.
