I cannot get access to my old email

Unfortunately, there is nothing that Microsoft is able to do. All personal Microsoft accounts come with access to other Microsoft services such as Xbox, Outlook, OneDrive, Office (With subscription) and other services. Because you have been using your brothers email address to sign into Xbox, Microsoft recognises this as it is your brothers Microsoft account, not yours.

Microsoft is not able to move an Xbox account, purchases, or game progress from one Microsoft account to another. Everything is permanently tied to the account that was originally used.

Even if this were your Microsoft account, Microsoft will not be able to reset security info or reset the password unless the request came from the official Microsoft account recovery form. Microsoft takes privacy and security extremely seriously, and only a very small, specialised team can reset account credentials. They can only do this when they are 100% certain the requester is the legitimate account owner. In this case, the account belongs to your brother, not you.

The only option you are able to do in this case is to sign into Xbox with your own Microsoft account and start fresh. This means that you will loose any purchases and progress made under your brothers account. Even if you do manage to get into contact with your brother, sharing a Microsoft account breaches the Microsoft service agreement, and Xbox Community Standards. You can find these here:
