Is there a setting to prefer 5GHz networks on the Surface Pro 3?

No.

The options are as follows:

  1. Set it to 5GHz which will only connect to 5GHz network (this is fine until you're somewhere without 5GHz, then, extremely inconvenient).
  2. Set it to Auto which will prefer 2.4GHz almost every time (even if you're a few metres from the router with full strength where 5GHz is optimal).

Both of these options fail to allow us to PREFER 5GHz, but still connect to 2.4GHz when a 5GHz network isn't available.

Please mark as answered as this is the only answer until Microsoft/Marvell fixes it (unlikely).

Is there a way to specify preferences on the Surface Pro 3 to connect to 5GHz networks when both

On January 15, 2015, Microsoft released a package of drivers to Windows Update that includes an updated Marvell WiFi driver for the Surface Pro 3. If you are one of the folks that has been trying to resolve issues of connecting to 2.4GHz instead of 5 GHz on your dual band router, this new driver includes settings to fine tune your connectivity preferences when both  5GHz and 2.4 GHz networks are available.

See http://answers.microsoft.com/en-us/surface/wiki/surfpro3-surfnetwork/specify-24-or-5-ghz-wifi-bands-selectively-on/0015e765-92ce-40c8-923b-9347b398f1b0?tm=1421365422515 for instructions on how to do this.

This is not an answer.  It is a workaround at best.  The original request is that 5ghz be preferred when both bands are available.  The suggestion given enables 5ghz only.  This requires manual intervention when both bands are available and manual intervention again when only 2.4ghz is available.

I use different SSIDs for my 2.4GHz and 5GHz WiFi - there's never been a problem with any device as a result. My Pro 3 connects to 5GHz at 866 Mbps most of the time.

    Bye.
