Bing Image Creator Images usage in Mobile Apps published in Google Play & App Store

Hello,
I see that images created by bing image creator are not allowed for commercial use. However, I am actually confused about what commercial use is. I see people generally ask/talk about selling pics created by bing and this is obviously a commercial use and not allowed.

What I want to do is that using some bing images in a mobile app that I am developing at the moment. So, this will be an app firstly in Google Play, maybe also App Store in the future as well. The app will be free to download but I aim to generate revenue with ads or maybe even with some in-app purchases. But the app will not sell any images created by bing, you know in-app purchases will be only about to unlock some features in the app. So, images will be just a part/asset of the app, they won't be sold.

So, in this case can I use bing images in my app? or not?

Thanks in advance.

    Hello,
    Thank you for your answer.
Is there a way to be able to use them?
I don't know maybe pay for the images or credit the bing image creator somewhere in the app? I read about this Bing Image Creator Watermark. So, if the watermak is added to the images, then it is ok to use them for commercial use? - > https://answers.microsoft.com/en-us/bing/forum/all/use-of-bing-image-creator-dall-e-3-for/8e4c7102-10c3-45c9-aa9b-2bb6d4faa519 So is that true? If yes, how can I get this watermak? I don't see any watermarks in the images.
    Thanks again

    Hi Epsilon,

I'm Dyari. Thanks for reaching out. I will be happy to assist you in this regard.

I'm afraid that, depending on Microsoft's terms of service, you can only use the AI images created for personal use, not for commercial purposes directly or indirectly.

    https://www.bing.com/new/termsofuse?FORM=GENTOS

    https://www.microsoft.com/en-us/legal/terms-of-use

Your developed app is free but you may get money with ads or as you mentioned maybe even with some in-app purchases. So, it falls under commercial use.

When it comes to personal use, an example would be creating an image and displaying it in my room not for commercial purposes.

Please feel free to ask if you have more questions.

I am sorry but no official announcement or article mentions that using Watermark on the AI-created images for commercial purposes is allowed.

Usually, when you use a copyrighted product, you must mention the owner of that product but I have never seen any Copilot Watermark on any products so far.

So, it is best not to use any AI-generated images for commercial purposes.

Please feel free to ask if you have more questions.
