- To clarify, by legacy mode, are you referring to Uniform orchestration mode?
- Elaborate on what do you mean by DCR. Is it Docker Container registry or Data Collection Rules?
Ques 1: To answer your first question about differences between the two orchestration modes for VMSS:

Note that System assigned Managed Identity isn't currently supported with Virtual Machine Scale Sets in Flexible orchestration mode. You would need to use User assigned Managed Identity instead. See Unsupported parameters
The error message you provided indicates that VMSS with flexible orchestration mode is not currently supported for DCR as it does not use system-assigned managed identity.
This error can occur when you try to deploy a VMSS with flexible orchestration mode and DCR in the same resource group. You can resolve this error by using user-assigned managed identity instead of system-assigned managed identity for DCR or by using a different resource group for DCR and VMSS.
