Backups software goes wrong on Graph API response for onedrive

Hello,
We have a backup solution and we backup a lot of tenant. When the user doesnt have a license or onedrive enabled the backup software want to get an Error 404 not found.
But for some tenants and users we get an error 403 instead of 404.
We can simulate this using the graph explorer but we cannot open a microsoft case and the backup software development says it is an microsoft issue and not their problem.
Any idea how we can fix this ?
