Question about age restrictions for using OpenAI

Dear Sir/Madam,

I have read an article stating that according to the terms of use, only minors aged 13 and above can use ChatGPT, and those under 18 require parental permission. If a system uses the ChatGPT model from the Azure OpenAI service, does that system also restrict usage to those aged 13 and above, and require parental permission for those under 18?

I appreciate your time and attention to this matter.

Sincerely,
Nagisa Hosono

NOLTY 保守 Greetings & Welcome to Microsoft Q&A Forum. Thank you for posting your query here!

In Addition to the above response, From an OpenAI perspective, in terms of use are for using all of their services in the referenced page while signing up for an account and its usage directly.

From Microsoft perspective, your use of the Azure services is governed by the terms and conditions as defined on this page. This includes the Microsoft Customer Agreement ("MCA"), or the Microsoft Online Subscription Agreement ("MOSA"). So, Azure OpenAI also has the same terms since it is offered under an Azure subscription.

Specifically for the use of AI related services, Responsible AI requires developers or app owners to disclose the use of AI services as part of the transparency notes for each of the services. So, while enabling the usage of the service by students it is important you disclose the use of AI in your application and request consent to use the service depending on solution you are offering to students.

Also, Azure OpenAI is currently not available to personal accounts so any request to use the service means it has to be requested by an account managed by an organization where domain verification is done by the gating team for further confirmation. This ensures the service is available to MS managed customers who already have an azure subscription and are bound by the customer agreements of their subscriptions.

    Hi NOLTY 保守,

Thanks for reaching out to Microsoft Q&A.

According to OpenAI's terms of use, users must be at least 13 years old to access their services, including ChatGPT. Additionally, individuals under the age of 18 are required to obtain parental or legal guardian consent to use these services.

When it comes to systems utilizing the ChatGPT model through the Azure OpenAI service, the same age restrictions apply. The terms of use are consistent across different platforms that implement OpenAI's technology, meaning that any application or service that integrates ChatGPT must also enforce the minimum age requirement of 13 years and seek permission for users under 18.

This approach is in line with legal requirements in various jurisdictions, including the U.S., which mandates that companies cannot collect personal information from children under 13 without explicit consent. Therefore, if a system is built on Azure OpenAI services, it should implement similar age verification processes to comply with these regulations.
