Bing API terms appear to conflict with Azure OpenAI for enterprise customers

Hello,

We purchased Azure OpenAI enterprise based on the commitments made by MS related to not using our data to train or improve Azure Open AI (see: https://learn.microsoft.com/en-us/legal/cognitive-services/openai/data-privacy?tabs=azure-portal).

We also are utilized Bing API to integrate with Azure OpenAI. Here are the Bing API terms of use (including with LLMs). These terms reference Bing privacy statement: https://privacy.microsoft.com/en-us/privacystatement

These terms state:

"As part of our efforts to improve and develop our products, we may use your data to develop and train our AI models. Learn more here." and "Microsoft uses the data we collect to provide you with rich, interactive experiences. In particular, we use data to: Improve and develop our products."

Can you please clarify whether if we are using Bing API with Azure OpenAI Enterprise which terms prevail.
