License assignment is not enforced in SPO. So yes, you must have a license to comply with the terms of service/license agreement, but you won't be blocked from using SPO if you don't.
Users without any license are able to create online office documents inside sharepoint document library
I am testing how the licensing differ inside our SharePoint site >> where i created a test user without any permission >> and i login using this user to a SharePoint document library >> where i were able to create online documents such as word & excel, as follow:-
here is the user license:-
Now based on my reading to get a license to use the online office app the user must have a license as mentioned in this link @ https://www.microsoft.com/en-ww/microsoft-365/enterprise/compare-office-365-plans
so can anyone advice why a user without any license is able to create online office documents?

license is able to create online office documents.
