Legality of Using Kinect as Motion Capture Hardware

Hi there,
I understand that the topic has been aired before but it was like a long time ago so this is like "How about now?" question.

I am looking for a method for affordable motion capturing for a commercially made game development products.
I stumbled upon a method which use the Kinect 360 and v2.0 as the Motion Capture Hardware. I wonder is it legal "now" to use the kinect and its SDK to gather the Motion Capture Data for a commercially made game products?

    Kinect for Windows v1 and v2, and associated SDKs, were designed for use by Windows users and Windows application developers. The SDKs shipped with certain redistributable components to allow for commercial application compatibility. The EULAs that accompanied those products did not contain an expiration date. For more information, consult the EULAs that accompanied the products.

    **Note: ** Kinect for Windows v1 and v2 have been discontinued. We recommend that you consider using Azure Kinect for your mocap needs
