DPM Backup keeps failing - Replica is inconsistent

We have one backup which is always fails in the morning with the error Replica is inconsistent. Backups take place 3 times a day and we only seem to have this issue in the morning.

We are taking a backup of a Data folder on the D: no larger than 6GB

Protection agent on "server name" was unexpectedly shut down during synchronization. DPM may have replicated data partially for Volume D:. (ID 30187 Details: Internal error code: 0x809909D5)

Actions taken so far:

1) Recreated the job
2) Created new hard-disk migrated data across
3) Tried throttling job using 70% available bandwidth
4) Agent reinstalled with latest version
5) Have confirmed that the server does not restart.

Scratching the head at the moment, any help will be appreciated.

    Hi there,

    This problem occurs if the network is experiencing high latency, or if the network is saturated with data transfers. When these conditions are true, DCOM traffic is delayed. This causes the agents to time out intermittently.

    To work around this problem, enable DPM throttling of 85 through 90 percent to make sure that bandwidth is available for DCOM calls.
