Commercial End User Trial Agreement
This Agreement Is between Your Organization and Microsoft
This Commercial End User Trial Agreement ("Agreement") governs enrollment in and use of the Trial Services by you, your Organization, and anyone given access to the Trial Services.
You are entering into this Agreement on behalf of your Organization and not in your individual capacity. By using your Organization-assigned email address to enroll in the Trial Services, you represent that you:
- have authority to enter into this Agreement on behalf of your Organization; and
- will comply with your Organization's policies relevant to enrollment, purchase, and use of the Trial Services.
Licenses for the Trial Services are owned and controlled by your Organization. This is true even if you provide your personal payment information when enrolling in the Trial Services. Your Organization has full control over the Trial Services and may cancel, reassign, or otherwise restrict access to the Trial Services at any time.
Data Access and Retention
Your Organization may at any time access and process all Trial Services Data, including the contents of your communications and files. Your Organization may also restrict your ability to access, move, or delete Trial Services Data.
Trial Services are provided for evaluation purposes only and are not intended for use in a Production Environment as defined in the Product Terms. When the Trial Services Term ends or access to the Trial Services is otherwise terminated, all Trial Services Data will be deleted. Microsoft has no obligation to return Trial Services Data to you or your Organization.
Applicable Terms
Any data collected during enrollment for the Trial Services, including without limitation your name, contact information, and payment information, is governed by the Microsoft Privacy Statement.
Use of the Trial Services is governed by your Organization's Microsoft volume licensing agreement, the Product Terms, and the Data Protection Addendum (DPA).
Term and Termination
Trial Services are provided on a trial basis for a limited duration as specified during enrollment and in Trial Services product documentation, if any (the "Trial Services Term"). Microsoft may modify the Trial Services Term or terminate access to the Trial Services at any time and for any reason.
Definitions
Trial Services means the Microsoft-hosted services in which you are enrolling under this Agreement, as described during enrollment and in Trial Services product documentation, if any.
Organization means the business or other entity that owns the email domain of the email address used to enroll in the Trial Services. For example, if you enrolled in the Trial Services using the email address yourname@contoso.com, your Organization is the entity that owns contoso.com and that assigned the email address to you.
Trial Services Data means all data, including all text, sound, video, or image files, and software, that are provided to Microsoft through use of the Trial Services by, or on behalf of, you, your Organization, or anyone given access to the Trial Services. Trial Services Data may include Customer Data and Personal Data as defined in the DPA.
Microsoft Privacy Statement means the Microsoft Privacy Statement published at https://aka.ms/Privacy.
Product Terms means Microsoft Product Terms published at https://aka.ms/ProductTerms.
Data Protection Addendum or DPA means the Microsoft Products and Services Data Protection Addendum published at https://aka.ms/DPA.
