For detailed information about the license issue, please call 1-800-426-9400, Monday through Friday, 6:00 A.M. to 6:00 P.M. (Pacific Time) to speak directly to a Microsoft licensing specialist. For international customers, please use the https://www.microsoft.com/en-us/licensing/worldwide to find contact information in your locations.

However, a SQL License is simply a piece of paper. The server does not track or enforce licensing.

It might help if you could tell us a little more about your environment...

From what I understand, you have a SQL Server with at least one database, and you want to restore it somewhere... now you are asking if that restore still uses the "former" license?

What kind of SQL Server do you have?
    Is a VM on-premise?
Is it a VM on Azure?
Is it an Azure Managed Instance or "just" an Azure SQL database?

Where do you want to restore the database?
    On the same server?

I don't know what a "Datto bare metal restore" is, but if the purpose of the restore is to provide users a second environment where they can run production queries, yes, you need a second license.

On the other hand, if the purpose is only to test the application, you may not need any license. If you want to run DBCC on it, there is something in the back of my head that you need a license, unless you have Software Assurance.

Anyway, the above are by no means authoritative information - this is a technical forum, and we are all laymen in legal matters here. Tom's post has the information how you should find the answers from a trustworthy source.

    Hi @Ryan Menard ,

I am not familiar with Datto bare metal restore, I search this from google, in a bare metal restore, an identical computer image/instance is recreated on a bare metal computer, from the ground up. The process involves reinstalling the operating system, applications as well as restoring a users data and settings.

This operation created a new SQL server instance. You need to purchase an additional SQL license when you use this instance for production.

But for SQL server License issue, I suggest that you can consult professionals in this area. please call 1-800-426-9400, Monday through Friday, 6:00 A.M. to 6:00 P.M. (Pacific Time) to speak directly to a Microsoft licensing specialist. Or you can go to Volume Licensing Service Center support. Please choose region/language and choose to call or have web. People there will help you more effectively.

    Hope this could help you.
